MARKETPLACE TERMS
The deal between Chonk and its members.
These terms apply when you browse, create an account, list, bid or message on Chonk.
1. About these terms
These terms govern use of the Chonk marketplace.
Chonk is operated by Vikkineshwaran Siva Subramaniam. Contact: hello@chonkmarket.com.
2. Accepting these terms
By creating an account or using member features, you agree to these Terms, the Listing Rules, Seller Review Rules, Privacy Notice and Complaints Process. You must be at least 18 and able to enter contracts.
3. Chonk’s role
Chonk supplies classifieds, profile, messaging and auction tools for goods, services and wanted adverts. Chonk is not the buyer, seller, employer, recruiter, service provider, broker, customs agent, auctioneer, payment provider or delivery company. Chonk does not inspect every item or verify every person, qualification, service, request or legal permission.
4. Accounts
Use accurate information, protect your sign-in method and tell Chonk promptly about unauthorised access. Do not use extra accounts to evade a restriction, manipulate bids or mislead members.
5. Sellers
- Own the item or have authority to offer it.
- Use current, representative photos and an honest description.
- Disclose condition, damage, treatments, pest or disease history and material faults.
- State postage, collection and additional costs clearly.
- Keep price and availability current and mark an item taken promptly.
- State accurately whether the sale is private or business.
- Keep any Chonk seller-directory declaration accurate, including professional-operator registration, registration reference, plant-passport authorisation and distance-selling status.
- Follow plant-health, invasive-species, wildlife-trade, consumer, tax and product-safety law.
Business sellers remain responsible for the information and rights owed to consumers. Chonk displays member seller-directory declarations but does not independently verify them or treat them as a quality endorsement.
6. Buyers and messages
Ask questions and check the item before buying. Messages must be genuine, lawful and respectful. Do not send spam, scams, threats, discriminatory abuse, sexual content, passwords or security-code requests.
6A. Services and requests
Service providers and people posting wanted, help or work adverts must describe the scope, location, timing, prices, pay, qualifications, insurance and permissions accurately. Members agree work, payment and responsibility directly. Import, export, brokerage and tissue-culture activity must follow customs, plant-health, wildlife-trade, employment and other applicable law.
7. Auctions and bids
Bid only if genuinely prepared to buy. Do not bid on your own item, arrange false bids, use another account to raise a price or interfere with an auction. Chonk records bids but does not collect payment or guarantee completion. The seller and highest valid bidder confirm the final transaction directly.
8. Payment and delivery
Members can arrange payment and delivery directly, free of Chonk transaction charges. When an advert offers optional Chonk checkout, the purchase and seller payment terms apply to that order, including the 10% buyer service charge, delayed seller payment release and dispute review. Stripe processes checkout payments. Chonk does not offer escrow.
8A. Seller reviews
Reviews must describe the reviewer’s own genuine, recent experience and comply with the Seller Review Rules. Fake, copied, self-authored, competitor, retaliatory or concealed-incentivised reviews are prohibited. A “completion confirmed by both members” label means both members exchanged messages and each used the completion control after an included advert was marked sold, rehomed or completed. It does not verify payment, purchase, delivery, item condition, handover or every claim in a review. Sellers cannot remove reviews from their page. Chonk applies the same checks to positive and negative reviews and may investigate, remove or restore a review under its neutral moderation and appeal process.
9. Your content
You keep ownership of content you upload. You give Chonk a non-exclusive, worldwide, royalty-free licence to host, store, copy, resize, display and distribute it only as needed to operate, secure and promote the service. You confirm that you have permission to upload it. The licence ends when content is deleted, except for limited backups, moderation evidence and required records.
10. Illegal content and safety
Do not upload or send content that is illegal or facilitates crime, including fraud, threats, harassment, hate offences, terrorism, illegal drug or weapon sales, sexual exploitation, child sexual abuse material, intimate-image abuse or encouragement of suicide or serious self-harm. Report concerning content promptly. Do not copy or redistribute suspected illegal material.
11. Moderation
Chonk may investigate, reduce visibility, remove content, preserve evidence, block contact, warn or suspend a member, close an account and report matters to an authority. Decisions consider severity, risk, context, history and available evidence. Where appropriate, Chonk gives a reason and an appeal route. Details may be withheld where disclosure could create danger, identify a reporter, compromise security or breach law.
12. Suspension and closure
You may ask to close your account, subject to safety, complaint and legal records that must be kept. Chonk may restrict, suspend or close an account for serious or repeated breaches, fraud, safety risk, legal obligations or attempts to evade enforcement.
13. Availability and changes
Chonk may change, suspend or withdraw features. Availability is not guaranteed to be uninterrupted or error-free. Material term changes will be communicated before they take effect where required.
14. Liability
Nothing excludes liability that cannot legally be excluded, including fraud or death or personal injury caused by negligence. Nothing affects statutory consumer rights. Subject to those limits, Chonk is not responsible for user adverts or off-platform transactions. For orders paid through Chonk checkout, its obligations under the purchase terms apply. Nothing in these terms removes those obligations or statutory rights.
15. Law and disputes
Consumers keep the law and courts available where they live in the UK. Business use is governed by the law of England and Wales and its courts have exclusive jurisdiction. Use the complaints process first so the issue can be reviewed.
